Responsible Electrical Engineer (VEFK) in Germany – Legal Framework, Responsibilities and Practical Implementation
When international companies expand their operations to Germany, they are often confronted with a highly structured and regulated approach to occupational safety and technical compliance. One area that is frequently underestimated is the organization of electrical safety within the company.
In Germany, operating electrical installations automatically creates what is referred to as an “electrical operational area” (“elektrischer Betriebsteil”). This applies to a wide range of systems, including industrial control panels, machinery, building installations, charging infrastructure or photovoltaic systems. With this comes a clear legal obligation for the company to ensure safe operation, proper organization and compliance with national regulations.
Unlike in many other countries, electrical safety in Germany is not only a technical issue but also a matter of organizational responsibility at management level. Company directors and managing directors are legally responsible for ensuring that electrical systems are operated safely and in accordance with applicable regulations. This responsibility arises from various legal sources, including occupational safety laws, operational safety regulations and accident prevention rules.
A key concept in this context is the separation between overall management responsibility and technical responsibility. While the company management retains ultimate responsibility, the technical responsibility for the electrical operational area can and in practice must be delegated to a qualified person. This role is known as the “Responsible Electrical Engineer” or, in German terminology, the “Verantwortliche Elektrofachkraft (VEFK)”. The VEFK is responsible for organizing, managing and supervising all electrical activities within the company. This includes defining safe working procedures, ensuring that only qualified personnel perform electrical tasks, organizing inspections and maintenance, and verifying compliance with relevant standards such as DIN VDE regulations and DGUV provisions.
For many international companies, this concept is unfamiliar. In some cases, electrical responsibilities are informally assigned or assumed to be covered by external contractors. However, without a clearly defined and documented organizational structure, this can lead to significant legal and operational risks. One of the most common challenges is the absence of a clearly appointed VEFK. Even if qualified electricians are employed, this does not automatically fulfill the legal requirement for structured technical responsibility. Without formal appointment and integration into the company’s organization, the responsibility may fall back to the management level.
Another critical aspect is the organization of inspections according to DGUV Regulation 3. Companies are required to ensure that electrical installations are regularly inspected, documented and evaluated. However, without a defined technical authority, these processes are often incomplete or inconsistently implemented. For international companies, establishing a compliant electrical organization can be complex, especially when internal expertise or local knowledge is limited. In such cases, appointing an external Responsible Electrical Engineer (external VEFK) is often the most effective solution.
An external VEFK provides the necessary expertise, experience and understanding of German regulations. They take over the technical responsibility for the electrical operational area, establish a compliant organizational structure and ensure that all processes are implemented in a practical and sustainable way. This includes analyzing existing systems, defining responsibilities, setting up inspection strategies, evaluating risks and supporting internal teams. At the same time, the external VEFK acts as an interface between management and technical operations, ensuring that both legal and practical requirements are fulfilled. In many cases, this approach also supports the development of internal structures. Employees can be gradually trained and prepared to take on responsibility in the future, while the external VEFK ensures stability and compliance during this transition.
From a strategic perspective, appointing an external Responsible Electrical Engineer is not only a matter of compliance but also a proactive step towards risk management and operational reliability. It creates transparency, reduces liability risks and provides a solid foundation for safe and efficient operations in Germany.
